1. Scope and conclusion of contract
These General Terms and Conditions (AGB) apply to all contracts, services and offers between Skin Design e.K., owner Armend Loshaj (hereinafter “Provider”), and customers.
The AGB are made available before the contract is concluded and can be viewed at any time on the Provider’s website and in the studio. By making an appointment or buying a voucher, the customer accepts these AGB.
2. Services and offers
The services, prices and offers can be viewed on the Provider’s website and in the studio. Subject to change and errors. Persons under 18 require the written consent of their legal guardian.
3. Appointments, deposit, cancellation and cancellation fee
Appointments are binding.
A deposit of 10% of the total price is required for treatments.
This deposit is paid exclusively via the online booking system and processed through PayPal. PayPal’s terms and conditions also apply. The appointment is only confirmed as binding once the deposit has been paid.
For consultations, the full amount must be paid in advance. Here, too, payment is made via the booking system using PayPal.
Appointments can be cancelled or rescheduled free of charge up to 24 hours before the agreed time.
If an appointment is cancelled later or the customer does not attend, the Provider reserves the right to charge a cancellation fee equal to the deposit paid or the full consultation fee as lump-sum damages (Section 615 BGB, German Civil Code).
The cancellation fee does not apply if the appointment could be given to someone else at short notice.
The customer remains entitled to prove that no damage or less damage has occurred.
This rule is expressly pointed out with every appointment booking.
4. Prices and terms of payment
The prices valid at the time of booking apply.
All prices include statutory VAT. Special offers apply only to the respective promotion.
Payment is made on site in cash, by EC debit card or as agreed.
5. Vouchers
Vouchers are valid for three years from the date of issue and are transferable.
They can be redeemed for all services offered unless stated otherwise. They cannot be combined with special promotions and discounts.
Vouchers cannot be exchanged for cash.
A voucher purchase can only be withdrawn from as long as the voucher has not been redeemed and the statutory period of 14 days has not expired.
Withdrawal is excluded once the voucher has been redeemed or the period has expired.
The redemption conditions are clearly communicated with every voucher purchase.
Vouchers can only be redeemed at the location stated.
Vouchers can be bought in cash or by card in the studio, or online via PayPal. In this case, PayPal’s terms and conditions apply.
6. Right of withdrawal for appointment bookings
For appointments booked for a specific date and time, there is no right of withdrawal under Section 312g(2) No. 9 BGB (German Civil Code).
This is expressly pointed out during the booking process.
7. Liability
The Provider is liable without limitation for damage caused intentionally or through gross negligence, and for damage resulting from injury to life, body or health.
For other damage, the Provider is liable only in the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), but limited to the foreseeable damage typical for the contract.
Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
8. Delayed appointments and force majeure
If an appointment cannot take place for reasons beyond the Provider’s control (e.g. illness, force majeure), the customer will be informed without delay.
In this case, any payments already made will be refunded without delay.
9. Data protection
The Provider processes personal data exclusively within the framework of the applicable data protection laws.
The privacy policy can be viewed on the website and in the studio.
Customers have the right at any time to access, rectification, erasure or restriction of the processing of their data, as well as the right to data portability and the right to object.
10. Final provisions
Should individual provisions of these AGB be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
The statutory provision shall apply in place of the invalid provision.
